Welcome to a Profile Products LLC website, mobile app, or social media outlet (“Online Sources”), which have been made available by Profile Products LLC, its related companies or affiliates (“Profile Products”).  This Privacy Policy applies to visitors, purchasers and anyone else who accesses, uses or communicates with the Online Sources.  

Goods and Services

Profile Products manufactures and distributes environmental solutions, including erosion and sediment control products, turf and ornamental establishment products, and soil amendments, to a range of industries, including professional horticulture, specialty agriculture, consumer lawn and garden, sports fields, golf courses, mining, oil and gas reclamation, landfills, commercial/residential construction, and highway projects (“Good and Services”).  

Personal Information

Profile Products may collect information about you (“Personal Information”) in connection with your use of any Online Source and your purchase of any Goods and Services through an Online Source or otherwise.  

Personal Information may include:

• (a) contact information, including, without limitation, name, mailing address, telephone number, and email address;
• (b) payment information, including, credit or debit card information, other financial account information, and billing address;
• (c) information provided in connection with receiving or purchasing Goods or Services;
• (d) information provided in connection with any survey or promotion relating to Goods or Services or events of Profile Products;
• (e) identifying photographs and images;
• (f) experience preferences;
• (g) your history of purchases of Goods and Services;
• (h) your history of visiting any Online Source;
• (i) marketing preferences;
• (j) information from third party trusted sources to augment information supplied by you;
• (k) information collected by our servers, which may include log file information, including your web request, Internet Protocol (“IP”) address, browser type, referring or exit pages and URLs, number of clicks and how you interact with links on any Online Source, domain names, landing pages, pages viewed, and other such information;
• (l) similar information from emails sent to you which then help us track which emails are opened and which links are clicked by recipients;
• (m) device identifiers, e.g., small data files or similar data structures stored on or associated with your mobile device used to access an Online Source, which uniquely identify your mobile device; and
• (n) information collected by any user of a Profile Products app, such as, location and navigation information.  Personal Information does not include information about a business or aggregated information that cannot be associated with a specific individual. 

Personal Information Use

In addition to some of the specific uses of information we describe in this Privacy Policy, as well as any use to which you specifically consent, we may use the Personal Information to: (a) provide you with a positive customer experience; (b) provide you the Goods and Services that you purchase; (c) deliver you advertising content in connection with the Goods and Services; (d) provide, improve, test, and monitor the effectiveness of our network and security for the Online Sources; (e) develop new Goods and Services; (f) monitor metrics such as total number of visitors, traffic, and demographic patterns on the Online Sources; (g) diagnose or fix technology problems; and (h) automatically perform updates to the Online Sources. Service Providers (defined below) who receive your Personal Information (as described below) may associate such Personal Information with other information about you that such Service Providers have separately collected, subject to the policies, terms and conditions of such Service Providers. Personal information, including phone numbers collected for SMS consent, will not be shared with third parties or affiliates for marketing purposes unless otherwise set forth herein.

Personal Information Disclosure

We may share Personal Information as set forth above with businesses that are legally part of the same group of companies that Profile Products is part of, or that become part of that group.  We also may share your Personal Information as set forth above to providers that help us provide the Goods and Services to you (“Service Providers”). Our Service Providers will be given access to your Personal Information as is reasonably necessary to provide the Goods and Services under reasonable confidentiality terms.  We may remove parts of data that can identify you and share anonymized data with other parties. We may also combine your Personal Information with other information in a way that it is no longer associated with you and share that aggregated information. If we sell or otherwise transfer part or the whole of Profile Products or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation, etc.), your Personal Information may be among the items sold or transferred. The buyer or transferee will have to honor the commitments we have made in this Privacy Policy. We may access, preserve and share your Personal Information in response to a legal request (e.g., a search warrant, court order or subpoena, etc.) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share Personal Information when we have a good faith belief it is necessary to detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm.  Personal Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

Personal Information Storage

Your Personal Information collected through any Online Source may be stored and processed in the U.S. or any other country in which Profile Products maintains facilities.  Profile Products and Service Providers may transfer Personal Information that we collect about you, including Personal Information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer Personal Information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.  By registering for and using the Online Sources you consent to the transfer of Personal Information to the U.S. or to any other country in which Profile Products or Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.  This Privacy Policy is governed by U.S. law.  If you do not wish to consent to U.S. law or this Privacy Policy, you should not share Personal Information with us or use our Online Sources.  

Personal Information Security

We use commercially reasonable safeguards to help keep your Personal Information collected through the Online Sources secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. Profile Products has implemented physical, technological, and organizational safeguards and security measures designed to protect against the loss, misuse, unauthorized access or disclosure of your Personal Information under Profile Products’ control.  However, Profile Products cannot ensure the security of any Personal Information you transmit to Profile Products or guarantee that Personal Information on the Online Source may not be accessed, disclosed, altered, or destroyed.

Cookies

When you visit an Online Source, we may use cookies and similar technologies like pixels, web beacons, and local storage to collect information about how you use the Online Source and provide features to you.  Log file information may be reported by your browser each time you make a request to access (i.e., visit) an Online Source. It can also be provided when the content of the Online Source is downloaded to your browser or device.  

Analytics

We also may use third-party analytics tools to help us measure traffic and usage trends for the Online Sources. These tools collect information sent by your device or the Online Sources, including the web pages you visit, add-ons, and other information that assists us in improving the Online Sources and the Goods and Services.  We may collect and use this analytics information with analytics information from other users so that it cannot reasonably be used to identify any particular individual user.  

Surveys or Contests

From time-to-time, Profile Products may provide you the opportunity to participate in contests or surveys through an Online Source.  If you participate, we may collect Personal Information from you.  Participation in these surveys or contents is completely voluntary and you therefore have a choice whether or not to disclose the Personal Information in connection with the survey or contests.  

Tell-A-Friend

If you choose to use our referral services to tell a friend, we will ask you for your friend’s name and email address.  We will automatically send your friend a one-time email inviting your friend to visit the site.  

Special Offers and Updates

We will occasionally send you information on products, services, special deals, promotions through the use of monthly e-newsletter and individual email campaigns.  We may occasionally feature web pages on which you can register for special promotions or services provided in conjunction with our business partners.  

Consent

Profile Products gathers, uses and discloses your Personal Information as set forth in this Privacy Policy and with your consent, except where permitted by law without consent.  Your consent may be express or your consent may be reasonably inferred or implied from your actions.  An authorized representative may consent on your behalf in certain instances.  In the case of minor children, a parent or legal guardian may consent to our collection, use and disclosure of a minor’s Personal Information.  

Other Sources

We are not responsible for the practices employed by any websites, apps or social media site linked to or from our Online Sources, including the information or content contained within them. Please remember that when you use a link to go from our Online Sources to another website, app or social media site, our Privacy Policy does not apply to those third-party websites, apps or social media sites. Your browsing and interaction on any third-party source, including those that have a link on our website, are subject to that third party’s own rules and policies. 

Children’s Privacy

Profile Products does not knowingly collect or solicit any Personal Information from anyone under the age of 13 or knowingly allow such persons to register for any Online Source.  The Online Sources are not directed at children under the age of 13.  In the event that we learn that we have collected Personal Information from a child under the age of 13 without parental consent, we will delete that Personal Information as quickly as possible.  If you believe that we might have any information from or about a child under 13, please contact us.  

California Residents

If you are a California resident, you may have certain additional rights.  California Civil Code Section 1798.83 may permit you to request information regarding the disclosure of your Personal Information by Profile Products to third parties for those third parties’ direct marketing purposes.  California Business and Professions Code Section 22581 permits registered users who are minors to request and obtain deletion of certain posted content.  

Updated Terms

We reserve the right, in our sole discretion, to change this Privacy Policy (“Updated Policy”) from time to time.  You agree that we may notify you of the Updated Policy by posting it on the Online Sources, and that your use of the Online Sources after the effective date of the Updated Policy (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Policy. Therefore, you should review this Privacy Policy and any Updated Policy before using any Online Source. The Updated Policy will be effective as of the time of posting, or such later date as may be specified in the Updated Policy, and will apply to your use of the Online Sources from that point forward. This Privacy Policy will govern any disputes arising before the effective date of the Updated Policy.
